The Kenyan government’s seeming complicity or inability to prevent this affront to Ugandan citizens is deeply troubling.
By allowing Ugandan security operatives to cross into Kenya and essentially kidnap these individuals, Kenya has failed in its duty to safeguard the liberty and wellbeing of all people on its territory, regardless of their nationality or political affiliations.
The fact that the Ugandan government has not even gone through proper legal channels like deportation orders or extradition requests further underscores the lawlessness of these actions. This sets a dangerous precedent where countries can simply send their agents across borders to seize perceived dissidents or opponents at will.
The echoes of past abuses, such as the arrest of Balaki Kirya from Museveni’s group in the 1980s and the forced repatriation of Rwandan asylum seekers, are deeply disturbing. They reveal a pattern of regional governments infringing on the sovereignty of their neighbors and trampling on the basic rights of individuals. Kenya must now be held to account.
It must provide a full and transparent explanation of how this egregious violation of international norms was allowed to occur on its soil. The safety and liberty of all people, Kenyan and foreign, must be paramount, and Kenya has an obligation to protect that principle.
Going forward, Kenya must also strengthen its border security and coordination with neighboring states to ensure such brazen cross-border abductions do not happen again. The free movement of people and the inviolability of national borders are cornerstones of a stable, democratic regional order.
Kenya cannot afford to be complicit in undermining those foundations. This editorial calls on the Kenyan government to take immediate steps to investigate this incident, hold any responsible parties accountable, and put in place robust measures to safeguard the rights and freedoms of all individuals within its borders.
Failure to do so will only embolden regional actors to continue violating international law with impunity. Kenya must demonstrate its commitment to the rule of law and the protection of human rights, for the sake of its own citizens and its neighbors.
