The High court has granted unfettered access to relatives to ailing Kampala property mogul Mohan Musisi Kiwanuka.
This follows the successful application by his sisters Jalia Muwanga, Nantege Yudaya Nsereko, Berti Nsereko Kawooya and Sarah Nsereko in Miscellaneous Cause No.82 of 2023 at the civil division of the High court.
They applied to seek a determination of the mental health status of their brother. When the application came up for hearing on February 11, 2025, before justice Flavian Zeija, Kiwanuka’s lawyer Francis Buwule admitted his client is indeed mentally ill. So, the judge ordered that the sisters and other relatives of Kiwanuka be granted unfettered access to him.
BACKGROUND
In 2019, Mohan’s eldest son, Jordan Sebuliba, basing on a 2017 certified medical record, asked court to pronounce itself on the mental state of his father on grounds that he suffers from debilitating dementia, a brain condition that causes memory and thinking loss.
Incidentally, the report by a UK-based neurologist was done on the request of Mohan’s wife, Maria Kiwanuka, after she noticed lapses in his cognition. Months earlier, Mohan had just ordered for the eviction of Sebuliba, his siblings and his mother from all his properties in the upscale suburbs of Kololo and Nakasero.
Mohan did not testify in court but High court judge Musa Sekaana turned down a mental examination request. Instead, basing on his 30-minute observation and interaction with Mohan, Sekaana ruled that he was of sound mind to run his businesses as he wishes.
However, Sebuliba sought redress at the Court of Appeal under No. 61 of 2020 and Civil Appeal No. 43 of 2020. But just before Sebuliba’s appeal could be heard, Mohan’s lawyers admitted he is insane in another application by his sisters.
So, in the wake of High court’s confirmation that Mohan is indeed insane, Ssebuliba, in a February 12, 2025 letter through his lawyers of BKA Advocates, has written to the Court of Appeal registrar to bring to their attention that Mohan is indeed of unsound mind for reason of mental illness.
“During the said hearing [in Miscellaneous Cause No.82 Of 2023], counsel for Mohan Kiwanuka admitted that he is insane. The purpose of this letter, therefore, is to pray that you be pleased to take judicial notice of this order and of this development,” reads part of the notice.
In effect, Sebuliba seeks to convince the Court of Appeal that the decisions made by his father after the 2017 confirmation of his mental illness are null and void. It remains to be seen how court will proceed with the matter.

As a must, man is obligated to work, and we should appreciate him for going beyond the limits and daring to serve in his capacity.

What does ‘unfettered access’ mean? Can any relative arrive at his home say at 3.00 am ?
Can any relative pick him up and take him to any doctor? This case is far from over. Mr. Kiwanuka will be part of legal precedents for ages.

Insane?! Dear editor, please use a less discriminatory word. “Insane” is very stigmatizing.
It is high time Ugandan judges educate themselves on demenia and how it presents itself. People act normal in one hour and the next minute, they ask where they are or who you are. Without this education more grave mistakes will be made and more senior citizens will be taken advantaged of !
Friends, educate yourself! This about caring for a man that made significant contribution to our country more than about his property. Persons with Dementia need to see people they love and need to come out of home for good interaction & quality of life.

Ssekana needs mental check up, this guy might be suffering from dementia and still as a judge he continues to weigh matters unreasonably? Guys, that’s how he was even in school, i am not surprised whenever i read his final verdicts!
