Gov't loses Shs 600m appeal case against mayor Lukwago

The Court of Appeal has dismissed government’s application seeking to challenge the reinstatement in office of Kampala city Lord Mayor Erias Lukwago.

A panel of three Justices Kenneth Kakuru, Stephen Musota and Christopher Madrama dismissed the application challenging Justice Lydia Mugambe’s orders to reinstate Lukwago on grounds that it had no merit.

On Friday, the justices also ruled that their application had been overtaken by events. In March 2014, Justice Mugambe of the Civil Division of High court reinstated Lukwago as the lord mayor for Kampala after being impeached by the KCCA councillors over abuse of office and incompetence.

Justice Mugambe also ordered KCCA and government to compensate Lukwago all the costs Lukwago incurred as a result of unlawful impeachment which is approximately Shs 562 million.

However, the attorney general and KCCA being dissatisfied with the ruling appealed. Justice Mugambe denied them leave on grounds that it would prejudice the respondent. Attorney general and KCCA had to go to Court of Appeal arguing that the High court departed from the law on contempt by holding in contempt people who had not received the court order and had reportedly not been accorded a right to fair hearing.

These are; former attorney general Peter Nyombi (deceased), former Electoral Commission chairman Badru Kiggundu, former minister in charge of Kampala Frank Tumwebaze and former KCCA executive director Jennifer Musisi Ssemakula. 

Attorney general thus demanded Court of Appeal to grant the leave of court. However, during the hearing of this case, Lukwago through his lawyers argued that the application by attorney general was bad in law and amounted to abuse of court process in as far as the persons who were found to be in contempt of court order didn’t show any dissatisfaction with it. 

Lukwago also argued that the attorney general abused the interim order issued by the former deputy chief justice Steven Kavuma by locking his office up to the end of that term as lord mayor in 2016.

He also argued that he had been re-elected as lord mayor again in June 2016. It’s against this background that Court of Appeal has dismissed the application by attorney general and KCCA and ordered them to pay costs of the suit.

Court of Appeal made the only justice any true court can deliver, in a case like this!

Lord Mayor Erias Lukwago was elected by Ugandans & only them can judge him as the Mayor is untouchable as long as he is in office!

It's Museveni the criminal in office through fake elections & should be in prison for abuse of Ugandans' hospitality!

Museveni is so lucky, Ugandans don't know what belonging to their country formed by their tribal lands, living in it freely mean & they prefer being conquered, oppressed, slaves of migrant Museveni who will rule them for life!

What is it that M7 and his cronies want to prove? M7 already sapped up Lukwago's powers as a Mayor! As if that is not enough, now M7 wants Lukwago to work for free!

Well, as a power maniac M7 is, it's safe to say that he wont rest until Lukwago is out of office as a mayor.

Therefore as Ugandans, we need to unite and kick the bustard out. I like WWE, which stand for World Wrestling Entertainment.

The underlining word is Entertainment. So, though it's violent by nature, it's meant to entertain and the entertainers are just acting to entertain us, therefore they don't follow any rule or law what so ever. M7 runs Uganda as WWE.

M7 doesn't follow any rules and the country lacks a rule of law! Unfortunately nothing will ever change as long as M7 is in power. We all know it, but some, like Mengo/Mayiga/Mutebi and some religious leader, like the 2 bishops (Lwangas), are entertained by M7's violence and lack of rule of law and they are saying, "Awangale ai Sabalwanyi M7." We are in a quagmire

Acholi tribal leader is more inhuman, he worships Museveni, while elites just enjoy living & woudn't want the demon out!

Acholi tribal leder watched Museveni killed the people he pretends being leader of & lives so well & wouldn't want Museveni out!

When Museveni will be in complete control of Uganda, Acholi tribal leader will be the first he will get rid of!

M7 paid off the Acholi tribal leader just like he did to others. Akot, you are one of those who is and has been consistent. You have called for unity all along. You have been on the "tribal leaders" case for siding with M7.

Yet they clearly know that M7, his family/relative and cronies are grubbing our land and looting the country naked. Akot, keep up and continue to exposing those who support M7 to continue grubbing our land and looting our nation. Keep calling for unity.

I'm right behind you. I wont relent for a second to point out that it's Mengo/Maying/Mutebi, the triple M, and some religious leaders like the Lwangas who are some of those who prefer to maintain the status quo because the are comfortable!

M7 keeps paying them off and they don't care about the ruins the country is sinking in each and every second M7 clings on power!
