Drama in court as police detective recites Nyanzi's ‘vulgar’ poem

The presentation of a loutish poem allegedly written to insult the person of the president calmed tensions and caused excitement as the trial of Makerere University researcher Dr Stella Nyanzi kicked off at Buganda Road court yesterday.  

The poem was allegedly posted on Stella Nyanzi’s Facebook page on September 16, 2018, the day on which President Museveni celebrated his 74th birthday. It was crafted in vulgarity targeted at the president's late mother Esteri Kokundeka, and repeatedly wishing that Museveni should have died at the time of his birth so to save Uganda and its citizens from future suffering. 

Nyanzi is accused of offensive communication and cyber harassment. According to the prosecution, such statements disturbed the peace, quiet or right of privacy of President Museveni.  
Assistant Superintendent of Police (ASP) Bill Ndyamuhaki, the first witness in the stand, opted to read the poem when prosecutor Janat Kitimbo asked him to explain how offensive the poem was to the president. He stated that the use of words such as vaginas, smelly and creamy p***y, were too offensive to any sound person.  

The mood in the court presided over by Grade One magistrate Gladys Kamasanyu drastically changed from tense to loose as Ndyamuhaki read the poem word-per-word, amid laughter from court goers.    

Ndyamuhaki stated that he became Stella Nyanzi’s follower on Facebook in 2017 when he was assigned by the director of criminal investigations to investigate Nyanzi’s case. He said that when he opened the Facebook page, he was able to identify one account with an indecent write-up.

Ndyamuhaki further explained that he looked at the phone number used to activate the account and found out that it was an MTN number whose digits ended with 17. Ndyamuhaki, who was trained in cybercrime investigation by America’s Federal Bureau of Investigation (FBI), told the court that the account on which the poem was posted, was activated using an email ‘snyanzi@yahoo.com’.

He says he probed the email and found out that the number that created that email account was tallying with the one on Facebook account. Ndyamuhaki says that he later secured a court order to establish the name under which the said number was registered. He found out that it was in the name of Nyanzi Stella.

The prosecutor presented before the court the activation codes used to create Stella Nyanzi’s Facebook account, the documents showing the number that activated the Facebook account and the passport Nyanzi reportedly used to apply for that particular phone number from MTN.

But Nyanzi’s lawyer Isaac Semakadde protested that the exhibits were never disclosed to the defence team. The case has now been adjourned to April 9 to allow the prosecution to share the said documents. Meanwhile, another case still against Nyanzi in which she allegedly called President Museveni a 'pair of buttocks' was fixed for mention on April 24 by magistrate by the same court.

I know all cases of this kind are a preserve of the DPP who needs aggrieved witnesses to pin the accused.

However, I have tried in vain to establish who the complainant is in this case, guess somebody wants to appease Museveni.

Who is going to proof that she misused the computer because to do so one must prove that they were aggrieved as a result of the writings.

All these so-called charges are nothing but shit. Was it not the same Museveni calling former présidents from Northern Uganda pigs?

If he is not happy to be told the truth, then, he can go hang and bak to Tanzania where he came from other than disturbing Ugandans in their own rights.

WADADA roger, agreed, yet,

The only criminal is Museveni, yet not even those who pretend having studied law, understand it!

How can any one who knows real law even prosecute Dr Nyanzi while turning blind eyes-deaf ears to enslavemen of an entire people by a demon?

How can any real Ugandan accept to try Dr Nyanzi, knowing the country is owned & ruled by a demon who controls every institution, uses Ugandans to destroy one another...to just go on ruling/oppressing them till he drops dead of old age?

When Museveni will be no more, how will Ugandans look at themselves?

Why have Museveni turned us against ourselves & uses us to destroy one another like this?

How can Ugandans let Musevnei tribalistically divide & rule them, while using them against one another & for how much long?

Museveni is rwandese who has finally found a country of his own, Uganda & is making Ugandans understand to whom the country belongs!

Tanzania-Kenya saw through Museveni & didn't give him asylum!

But Ugandans, in UNITY, can throw Museveni out or he will go on till he dies of old age at +90!

Museveni has no respect for any Ugandan!

Prison is not simple. Bambi Stella has lost a lot of weight as if she has been sick for a while.

Anyway I am not a fan of M7 by any measure and this case is a wasat of time but I think among dictators in this world he is tolerant. You cannot write such in North Korea or Rwanda and still be alive

Lucky how some government officials earn a wage on tax payers money by reading other people's facebook accounts.

Surely the President of Uganda should be the one to read and to personally take his case to the higher courts of law. One cannot see how the tax payer benefits from paying for the upkeep of M/s Nyanzi in Luzira Prison and meeting the legal costs of abusing the late Mrs Esteri who was a Mulokole by Christian faith.

My mother was a Mulokole and she was abused many times by fellow women and men for preaching the gospel of Christianity in public. She never took the abusers to the courts of law. Actually many afterwards ended up becoming diehard Christians.

One wants to bet, if the late Mrs Esteri woke up from her grave with her Jesus in her hands, she would tell Mrs Nyanzi to go home and turn Christian and try to behave herself in the future.

She would discontinue that case. It is difficult to know what she will then tell her elder son!
