Gashumba sues CMI over detention without trial

Social media activist, Frank Gashumba has sued the Chieftaincy of Military Intelligence (CMI), Grace Akullo, the director Criminal Investigations and the commandant of the Special Investigations Division in Kireka.

Gashumba's lawyer Denis Nyombi has filed a suit before Nakawa Chief Magistrate's court contesting the continued detention of his client since October 31 without charge. In the application, Nyombi is seeking court orders for the immediate release of Gashumba and his brother Innocent Kasumba.

He says the continued detention of the duo without charge is unlawful, unjustified and unconstitutional. Nyombi also says that the suspects have been denied their right to legal representation as they can't be reached by their lawyers.

"They have also been denied police bond and yet no charges have been preferred against them," reads the application in part.

Gashumba was detained on Monday; two days after his brother was picked up for allegedly impersonating a Defense ministry official and obtaining money by false pretense.

Later, CMI paraded the duo before the media.  The Defense ministry, deputy spokesperson Lt. Col. Deo Akiiki said the duo was picked up following a whistle blower's report indicating that they were trying to fleece an investor. 

The two are said to have invited the investor to a city hotel for a meeting claiming to have been contracted by the army to supply military trucks. A search in the suspect's homes led to the recovery of several passports, stamps and ministry of Defense documents according to Akiiki.

It is not yet clear when the suspects will appear in court.

I still hold my prediction that Gashumba will be released soon.

He will never be tried, but his file will remain open as long as he keeps quiet like Stella Nyanzi , or joins other former inmates like Mwenda , Mike Mukula , and Prof. Bukenya aka X-Mahogany.

Gashumba, you can't have your cake and eat it too. You would have been fine hadn't provoked the fountain of humor.

He has always know that you are mischievous but only gave you a pass because you weren't trying to destabilize him. Now you have to dance to the music.

They will line up several offences, split them into pieces, discharge him for one offence, release him and arrest him on another
